The Platform and all of its contents — including but not limited to text, graphics, logos, images, audio and video clips, data compilations, software code, interface design, trademarks, service marks, trade dress, and any other material — are the exclusive property of ArthIQ Labs LLC and are protected under applicable copyright, trademark, trade secret, and other intellectual property laws of the United States and international jurisdictions.

No portion of the Platform's content, code, design, or intellectual property may be reproduced, duplicated, copied, sold, resold, visited, scraped, framed, distributed, publicly displayed, transmitted, modified, or otherwise exploited for any purpose — commercial or otherwise — without the prior express written consent of ArthIQ Labs LLC. Unauthorized use of any materials appearing on the Platform may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.

The name “JanamPatri,” the JanamPatri logo, and all related marks, trade names, and slogans are trademarks of ArthIQ Labs LLC. Nothing in these Terms grants you any right or license to use any trademark, service mark, or trade name of ArthIQ Labs LLC without our prior written permission.

THE PLATFORM, INCLUDING ALL CONTENT, TOOLS, FEATURES, SERVICES, AND INFORMATION MADE AVAILABLE THROUGH IT, IS PROVIDED STRICTLY ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY.

ArthIQ Labs LLC does not warrant that: (a) the Platform will be uninterrupted, error-free, or free of viruses or other harmful components; (b) the results obtained from using the Platform will be accurate, reliable, or meet your expectations; (c) any errors or defects in the Platform will be corrected; or (d) the Platform or the server that makes it available are free of viruses, malware, or other harmful components.

Astrology, Jyotish, and related services offered through the Platform are provided for entertainment, informational, and personal reflection purposes only. Nothing on the Platform constitutes professional financial, legal, medical, psychological, or any other form of regulated professional advice. ArthIQ Labs LLC makes no representation or warranty regarding the accuracy, completeness, or usefulness of any astrological reading, prediction, or consultation provided through the Platform.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARTHIQ LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, ARISING FROM OR RELATED TO:

• Your access to, use of, or inability to access or use the Platform;
• Any content, information, services, or products obtained through the Platform;
• Unauthorized access to or alteration of your transmissions or data;
• Any reliance placed on information, opinions, advice, or representations made on or through the Platform;
• Loss of data, loss of profits, loss of business, business interruption, or loss of goodwill;
• Any errors, omissions, interruptions, deletions, defects, delays in operation or transmission;
• Any conduct or content of any third party on the Platform, including any defamatory, offensive, or illegal conduct;
• Any outcomes resulting from consultations booked or conducted through the Platform.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF ARTHIQ LABS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU ACCESS AND USE THE PLATFORM ENTIRELY AT YOUR OWN RISK. ARTHIQ LABS LLC ASSUMES NO RESPONSIBILITY WHATSOEVER FOR ANY OUTCOMES — FINANCIAL, PERSONAL, PROFESSIONAL, OR OTHERWISE — RESULTING FROM YOUR USE OF THE PLATFORM OR ANY CONSULTATION, READING, OR SERVICE OBTAINED THROUGH IT.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, ArthIQ Labs LLC's liability shall be limited to the maximum extent permitted by law. In no event shall ArthIQ Labs LLC's aggregate liability to you for all claims arising out of or relating to the Platform exceed the greater of (a) the total amount paid by you to ArthIQ Labs LLC in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD $100.00).

The Platform may allow users, registered astrologers, contributors, and other third parties to post, submit, publish, or otherwise make available reviews, ratings, profiles, testimonials, comments, messages, and other content (“User Content”).

Views and opinions expressed by users, astrologers, contributors, or any third parties on the Platform are solely their own and do not represent, reflect, or imply the views, positions, policies, or endorsement of ArthIQ Labs LLC in any manner whatsoever.

ArthIQ Labs LLC does not verify, endorse, guarantee, or assume responsibility for the accuracy, completeness, reliability, or quality of any User Content or third-party representations made on or through the Platform. You acknowledge that any reliance on User Content is at your sole risk.

ArthIQ Labs LLC shall not be held liable, responsible, or accountable in any capacity — whether legally, financially, or otherwise — for any User Content, opinions, claims, predictions, representations, or advice made available on the Platform by any user, astrologer, or third party. ArthIQ Labs LLC is a marketplace connecting users with independent astrology practitioners and is not responsible for the quality, accuracy, or outcomes of any individual consultation or reading.

By submitting User Content to the Platform, you grant ArthIQ Labs LLC a non-exclusive, royalty-free, worldwide, irrevocable license to use, display, reproduce, and distribute your User Content solely in connection with operating and improving the Platform. You represent and warrant that you have all necessary rights to grant this license.

You agree to indemnify, defend, and hold harmless ArthIQ Labs LLC and its officers, directors, employees, agents, licensors, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Platform;
• Your violation of these Terms;
• Your violation of any rights of another person or entity, including any intellectual property, privacy, or proprietary rights;
• Any User Content you submit, post, or transmit through the Platform;
• Your conduct in connection with any consultation or transaction conducted through the Platform.

ArthIQ Labs LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with ArthIQ Labs LLC in asserting any available defenses.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

If you are a consumer located outside the United States, you may also be entitled to the protection of mandatory provisions of consumer protection laws in your country of residence. These Terms do not limit any such rights to the extent applicable law prohibits their limitation.
