Terms of Use

The Platform and all of its contents — including but not limited to text, graphics, logos, images, audio and video clips, data compilations, software code, interface design, trademarks, service marks, trade dress, and any other material — are the exclusive property of ArthIQ Labs LLC and are protected under applicable copyright, trademark, trade secret, and other intellectual property laws of the United States and international jurisdictions.

No portion of the Platform's content, code, design, or intellectual property may be reproduced, duplicated, copied, sold, resold, visited, scraped, framed, distributed, publicly displayed, transmitted, modified, or otherwise exploited for any purpose — commercial or otherwise — without the prior express written consent of ArthIQ Labs LLC. Unauthorized use of any materials appearing on the Platform may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.

The name “JanamPatri,” the JanamPatri logo, and all related marks, trade names, and slogans are trademarks of ArthIQ Labs LLC. Nothing in these Terms grants you any right or license to use any trademark, service mark, or trade name of ArthIQ Labs LLC without our prior written permission.

THE PLATFORM, INCLUDING ALL CONTENT, TOOLS, FEATURES, SERVICES, AND INFORMATION MADE AVAILABLE THROUGH IT, IS PROVIDED STRICTLY ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY.

ArthIQ Labs LLC does not warrant that: (a) the Platform will be uninterrupted, error-free, or free of viruses or other harmful components; (b) the results obtained from using the Platform will be accurate, reliable, or meet your expectations; (c) any errors or defects in the Platform will be corrected; or (d) the Platform or the server that makes it available are free of viruses, malware, or other harmful components.

Astrology, Jyotish, and related services offered through the Platform are provided for entertainment, informational, and personal reflection purposes only. Nothing on the Platform constitutes professional financial, legal, medical, psychological, or any other form of regulated professional advice. ArthIQ Labs LLC makes no representation or warranty regarding the accuracy, completeness, or usefulness of any astrological reading, prediction, or consultation provided through the Platform.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARTHIQ LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, ARISING FROM OR RELATED TO:

• Your access to, use of, or inability to access or use the Platform;
• Any content, information, services, or products obtained through the Platform;
• Unauthorized access to or alteration of your transmissions or data;
• Any reliance placed on information, opinions, advice, or representations made on or through the Platform;
• Loss of data, loss of profits, loss of business, business interruption, or loss of goodwill;
• Any errors, omissions, interruptions, deletions, defects, delays in operation or transmission;
• Any conduct or content of any third party on the Platform, including any defamatory, offensive, or illegal conduct;
• Any outcomes resulting from consultations booked or conducted through the Platform.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF ARTHIQ LABS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU ACCESS AND USE THE PLATFORM ENTIRELY AT YOUR OWN RISK. ARTHIQ LABS LLC ASSUMES NO RESPONSIBILITY WHATSOEVER FOR ANY OUTCOMES — FINANCIAL, PERSONAL, PROFESSIONAL, OR OTHERWISE — RESULTING FROM YOUR USE OF THE PLATFORM OR ANY CONSULTATION, READING, OR SERVICE OBTAINED THROUGH IT.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, ArthIQ Labs LLC's liability shall be limited to the maximum extent permitted by law. In no event shall ArthIQ Labs LLC's aggregate liability to you for all claims arising out of or relating to the Platform exceed the greater of (a) the total amount paid by you to ArthIQ Labs LLC in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD $100.00).

The Platform may allow users, registered astrologers, contributors, and other third parties to post, submit, publish, or otherwise make available reviews, ratings, profiles, testimonials, comments, messages, and other content (“User Content”).

Views and opinions expressed by users, astrologers, contributors, or any third parties on the Platform are solely their own and do not represent, reflect, or imply the views, positions, policies, or endorsement of ArthIQ Labs LLC in any manner whatsoever.

ArthIQ Labs LLC does not verify, endorse, guarantee, or assume responsibility for the accuracy, completeness, reliability, or quality of any User Content or third-party representations made on or through the Platform. You acknowledge that any reliance on User Content is at your sole risk.

ArthIQ Labs LLC shall not be held liable, responsible, or accountable in any capacity — whether legally, financially, or otherwise — for any User Content, opinions, claims, predictions, representations, or advice made available on the Platform by any user, astrologer, or third party. ArthIQ Labs LLC is a marketplace connecting users with independent astrology practitioners and is not responsible for the quality, accuracy, or outcomes of any individual consultation or reading.

By submitting User Content to the Platform, you grant ArthIQ Labs LLC a non-exclusive, royalty-free, worldwide, irrevocable license to use, display, reproduce, and distribute your User Content solely in connection with operating and improving the Platform. You represent and warrant that you have all necessary rights to grant this license.

JanamPatri is a discovery and listing platform only. The Platform connects clients seeking astrological consultations with independent astrology practitioners. ArthIQ Labs LLC does not act as, and shall not be construed as, a Payment Aggregator (PA), Payment Gateway (PG), escrow service, payment intermediary, or financial institution of any kind under the laws of any jurisdiction, including but not limited to the guidelines issued by the Reserve Bank of India (RBI).

For consultations with astrologers based in India: All payments are made directlyfrom the client to the astrologer via Unified Payments Interface (UPI), QR code, or such other peer-to-peer payment method as may be displayed on the astrologer's profile. ArthIQ Labs LLC does not collect, process, hold, route, settle, or in any way intermediate these payments. No funds — whether in Indian Rupees (INR) or any other currency — flow through any bank account, wallet, or financial instrument owned or controlled by ArthIQ Labs LLC in connection with these transactions.

The Platform merely displays the astrologer's payment information (such as a UPI ID or QR code) as a convenience to facilitate direct payment between the client and the astrologer. The display of such payment information does not create any agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between ArthIQ Labs LLC and the astrologer or the client.

ArthIQ Labs LLC bears no responsibility or liability whatsoever for: (a) the success, failure, delay, or reversal of any payment between a client and an astrologer; (b) disputes regarding the amount, timing, or method of payment; (c) fraud, unauthorized transactions, or errors in payment processing by any third-party payment service (including UPI service providers); or (d) any financial loss suffered by either party in connection with a direct payment transaction.

All payment disputes are strictly between the client and the astrologer (and, where applicable, their respective payment service providers). ArthIQ Labs LLC will not mediate, arbitrate, or otherwise intervene in any payment dispute.

Astrologers listed on the Platform are independent practitioners and are not employees, contractors, agents, or representatives of ArthIQ Labs LLC. Each astrologer is solely responsible for all aspects of their practice, including the quality and accuracy of their consultations.

Tax Compliance:Each astrologer is solely and entirely responsible for their own tax obligations, including but not limited to: (a) registration under the Goods and Services Tax (GST) regime, if applicable, and timely filing of GST returns; (b) reporting of all income received through or in connection with the Platform under the Income Tax Act, 1961 (or equivalent legislation in the astrologer's jurisdiction); (c) payment of advance tax, self-assessment tax, and any other taxes, duties, levies, or cesses as may be applicable; and (d) issuance of invoices, receipts, or other documentation as required by law.

Statutory and Legal Compliance: Each astrologer shall comply with all applicable local, state, national, and international laws, rules, and regulations governing their practice, including but not limited to: (a) professional licensing or registration requirements, if any; (b) consumer protection laws; (c) anti-fraud and anti-money-laundering regulations; (d) data protection and privacy laws (including the Digital Personal Data Protection Act, 2023, or equivalent legislation); and (e) any other legal or regulatory requirement applicable to the provision of astrological or consultancy services.

ArthIQ Labs LLC does notprovide tax advice, legal counsel, or compliance guidance to astrologers. ArthIQ Labs LLC makes no representations regarding the tax treatment of payments received by astrologers and shall have no liability for any astrologer's failure to comply with applicable tax, statutory, or regulatory obligations.

Any penalties, interest, fines, or legal consequences arising from an astrologer's non-compliance with tax, statutory, or regulatory obligations are the sole responsibility of the astrologer concerned. ArthIQ Labs LLC reserves the right to suspend or remove any astrologer from the Platform who is found to be in violation of applicable laws or these Terms.

Astrologers who list their services on JanamPatri agree to the following obligations as a condition of their use of the Platform:

Non-Solicitation. Astrologers shall not directly or indirectly solicit, divert, or encourage any client who discovered them through the Platform to book consultations, purchase services, or engage in any transaction outside the Platform. This prohibition includes, without limitation, sharing personal contact information (telephone numbers, email addresses, social media handles, or personal website URLs) with Platform clients for the purpose of circumventing the Platform, and offering discounts or incentives to clients who book directly rather than through the Platform.

Duration. This non-solicitation obligation applies for the entire duration of the astrologer's active listing on the Platform and continues for a period of twelve (12) months following the deactivation, removal, or termination of the astrologer's account, regardless of the reason for such termination.

Platform Fee. JanamPatri.net charges a platform usage fee on paid consultations processed through the Platform. The current fee percentage is published on the Platform and may be updated from time to time at ArthIQ Labs LLC's sole discretion. Continued use of the Platform after any fee change constitutes acceptance of the revised fee. The fee is automatically deducted from each payment before settlement to the astrologer's payment account.

Platform Integrity. The Platform's ability to operate and invest in growth, quality, and user trust depends on the integrity of its fee structure. Circumventing the Platform to avoid fees undermines all participants in the marketplace and is treated as a material breach of these Terms.

Consequences of Violation. If JanamPatri.net, at its sole discretion, determines that an astrologer has violated the non-solicitation obligations set forth herein, JanamPatri.net reserves the right to: (a) immediately terminate the astrologer's account without prior notice; (b) permanently ban the astrologer from future registration or use of the Platform; (c) withhold any pending payouts; and (d) pursue any additional legal remedies available under applicable law, including recovery of lost platform fees.

Client Reporting. Clients are encouraged to report any instances of direct solicitation by astrologers. Reports can be submitted to legal@janampatri.net.

You agree to indemnify, defend, and hold harmless ArthIQ Labs LLC and its officers, directors, employees, agents, licensors, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Platform;
• Your violation of these Terms;
• Your violation of any rights of another person or entity, including any intellectual property, privacy, or proprietary rights;
• Any User Content you submit, post, or transmit through the Platform;
• Your conduct in connection with any consultation or transaction conducted through the Platform;
• Any payment dispute, chargeback, reversal, or financial claim arising from a direct payment transaction between a client and an astrologer;
• Any failure by an astrologer to comply with applicable tax laws (including GST and income tax), statutory obligations, or regulatory requirements;
• Any claim by a governmental or regulatory authority arising from an astrologer's non-compliance with applicable laws in connection with services offered through the Platform.
• Any violation of the non-solicitation or platform integrity obligations set forth in Section 7, including any direct solicitation of Platform clients or circumvention of Platform fees.

ArthIQ Labs LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with ArthIQ Labs LLC in asserting any available defenses.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law principles.

Mandatory Arbitration:Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Platform, any consultation booked through the Platform, or any payment or fee dispute (“Dispute”) shall be resolved by binding arbitrationadministered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator in Lake County, Illinois. The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this provision. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines that a claim was frivolous, in which case the arbitrator may award reasonable costs and fees to the prevailing party.

CLASS ACTION WAIVER: YOU AND ARTHIQ LABS LLC AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the Dispute shall proceed in court.

JURY TRIAL WAIVER: TO THE EXTENT ANY DISPUTE IS PERMITTED TO PROCEED IN COURT (WHETHER BECAUSE THE ARBITRATION PROVISION IS DEEMED UNENFORCEABLE OR PURSUANT TO AN EXCEPTION BELOW), BOTH YOU AND ARTHIQ LABS LLC IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY. Any such Dispute shall be tried before a judge sitting without a jury.

Small Claims Exception:Notwithstanding the above, either party may bring an individual action in small claims court for Disputes within that court's jurisdictional limits, provided the action remains in small claims court and is not removed or transferred to a court of general jurisdiction.

International Users: If you are located outside the United States, you may also be entitled to the protection of mandatory provisions of consumer protection laws in your country of residence. These Terms do not limit any such rights to the extent applicable law prohibits their limitation. However, you agree that the arbitration and class action waiver provisions above shall apply to the maximum extent permitted by applicable law.
